Parliamentary Secretary for Social Dialogue Andy Ellul has announced a new Government proposal granting miscarriage leave to women and their partners.

Speaking at a press conference, Dr Ellul confirmed that women who experience a miscarriage before the 22nd week of pregnancy will be entitled to seven consecutive days of paid leave.

This leave will be fully funded by the Government to avoid placing financial strain on employers. The payment will be based on the national median wage, which is more than double the minimum wage.

Importantly, the leave will also be extended to partners, including same-sex couples. It will apply equally to public and private sector workers, agency workers, the self-employed and part-time employees, who will receive pro-rata entitlement.

To qualify, a medical certificate from a gynaecologist will be required, without the need for detailed disclosure. The same certificate may be used by the partner to apply for leave.

Dr Ellul emphasised the importance of privacy. Employers will be guided to treat such situations with dignity and confidentiality. Employees will retain the right to return to their role without loss of conditions, even if they had not disclosed the pregnancy.

The Government will also offer psychological support and establish an anonymous register to track uptake. Dr Ellul said the policy followed wide consultation and reflects Malta’s commitment to social progress and emotional wellbeing in the workplace.
