PLANNING AUTHORITY LAUNCHES PUBLIC CONSULTATION ON NEW RECONSTRUCTION RULES

The Planning Authority has launched a two-week public consultation on a proposed Legal Notice that would amend the Development Notification Order (DNO) through the introduction of a new Class 25.
The amendment seeks to establish a clear planning framework for the restoration and reconstruction of buildings or structures that have been damaged or destroyed by natural disasters or other external events beyond the owner’s control. The reform is intended to address situations where legally established properties suffer sudden damage and require swift reinstatement, without creating any new development rights.
Under the proposal, reconstruction would only be permitted if the building is restored exactly to its pre-incident state. This means maintaining the same footprint, height, volume and use, with no extensions, additional floors, changes of use or intensified development allowed.
Applicants would be required to submit professional certification, proof of the building’s legal status prior to the incident, and official reports confirming the cause of damage. The Authority would retain the right to request further verification or reject notifications if doubts arise.
