Medical Association of Malta Welcomes New Health and Care Bills

The Medical Association of Malta (MAM) has welcomed the Health Professions Act and the Advanced Care Directive Act currently being debated in Parliament, expressing appreciation for the Government’s willingness to engage with the profession throughout the drafting process.

MAM described the Health Professions Act as an important step in modernising the regulatory framework for healthcare professionals. According to the Association, the Bill introduces clearer structures for professional governance, better definitions of scope of practice, and stronger accountability safeguards for both patients and practitioners. It also noted with satisfaction that several of its proposals were incorporated into the draft law, particularly those concerning fair disciplinary procedures, professional representation within regulatory bodies, and balanced oversight mechanisms.

The Advanced Care Directive Act was similarly welcomed as a significant development. MAM said the proposed legislation provides long-awaited clarity on patient autonomy and clinical decision-making in complex situations. The Association highlighted the inclusion of safeguards discussed during consultation, such as clearer documentation requirements, defined clinical processes, and appropriate legal protections for practitioners acting in good faith.

MAM also acknowledged the constructive dialogue held with the relevant Ministries during consultations, stating that the technical discussions contributed to more balanced and workable legislation. The Association affirmed its commitment to supporting the proper implementation of both Acts and to collaborating on any subsidiary regulations and professional guidance that may follow.
