Justice Minister Clifton Grima Announces Family Court Reform Taking Effect in October

The Government has published the 2026 Family Court Procedure Regulations, marking an important step towards the implementation of Malta’s Family Court reform.

The majority of the new regulations and related legislation will come into force on 1 October 2026. The reform aims to create a more accessible, efficient and child-focused family justice system, with clearer procedures and stronger safeguards for children involved in family proceedings.

Justice, Research and Innovation Minister Clifton Grima described the reform as more than a legal change, saying it represents a shift towards a more human and accessible system centred on the best interests of children. He also confirmed that work has already started on a further phase of the reform.

Social Policy and Family Minister Michael Falzon said the wellbeing of children remains at the heart of the changes, particularly for minors whose parents are going through separation. The reforms will introduce clearer timeframes, more specific maintenance criteria and greater responsibilities for both parents regarding access.

Implementation will also include the establishment of a Support Office, strengthening the Children’s Advocate function, recruiting specialised professionals and developing new operational procedures.

The Government said work is already underway on the second phase, which will build on the current reforms and further strengthen Malta’s family justice system.
