ELSA Debate Explores Legal Responsibility In Age Of A.I

The Ministry for Justice and Reform of the Construction Sector has once again supported the third edition of the Union Debate organised by ELSA Malta, held under the patronage of Alexiei Dingli. This year’s debate focused on the theme ‘Artificial Intelligence and the Question of Imputability’, bringing together students and professionals to examine one of the most pressing legal challenges of the digital age.

The event provided a platform for in depth discussion on how responsibility should be assigned in cases involving artificial intelligence. As technology continues to evolve at a rapid pace, particularly with the rise of generative systems capable of producing highly realistic synthetic media, questions around accountability are becoming increasingly complex.

Addressing attendees, Jonathan Attard, Minister for Justice and Reform of the Construction Sector, emphasised the importance of informed and balanced legislation. He stated that while laws must adapt to reflect both present and future realities, they should not penalise the responsible use of technology. At the same time, he stressed the need to ensure that misuse, including malicious applications of artificial intelligence, is adequately addressed through robust legal frameworks.

The Minister referred to recent developments in Malta’s Criminal Code, including the introduction of offences such as cyberstalking and cyberbullying, as examples of how legislation can respond to emerging digital threats. He also highlighted the growing concern surrounding deepfakes, noting plans for a public consultation and potential legislative amendments to strengthen protections in this area.

The debate attracted strong participation and continues to grow in popularity, reflecting increasing interest among students in the intersection between law and technology. Minister Attard encouraged young people to remain engaged, think critically and take an active role in shaping discussions that impact society.

The event also featured contributions from a number of legal professionals, including Dr Charles Mercieca, Dr Ian Gauci, Francesco Formosa, Emma Bugeja, Timmy Desira and Maya Briffa, highlighting the value of collaboration between academia and practice in addressing complex legal issues.
