Court Confirms The Planning Authority’s Decision Regarding Development In Santa Luċija

The Planning Authority notes and welcomes with satisfaction a recent judgment by the Court of Appeal which confirms that the Authority acted correctly when it refused a development project in Santa Luċija involving the demolition of an existing dwelling and the construction of new residences.
This decision was taken following an appeal filed by the Santa Luċija Local Council against a Tribunal ruling. Notably, the Court’s judgment reflects a position consistent with that put forward by both the Planning Authority and the third-party appellants, namely that the proposal, as originally submitted, could not be approved in its amended form at the appeal stage.
The Court in fact clarified that significant design changes cannot be introduced or approved at the appeal stage, since such changes must go through the established planning process, in which all interested parties—including local councils and technical consultants—are given the opportunity to participate. This ensures transparency and clarity for the community and for prospective applicants.
With the Court’s confirmation that substantial changes require a new or revised application, the judgment strengthens the procedural safeguards that guide the planning system and enhances predictability for all parties involved.
