Hospice Malta, a non-profit organisation dedicated to providing palliative care and support to individuals facing serious illness, is continuously supported by the generosity and commitment of its community. 

The recent example of three dedicated individuals who participated in the LifeStar Malta Marathon 2024 serves as a shining example of this dedication. Michael Degaetano, Keith Demicoli, and George Navarro showcased their unwavering commitment by participating in various events of the marathon, rallying support, and raising funds for Hospice Malta.

Keith Demicoli, reflecting on his motivation, stated, “Running the Malta Half Marathon for Hospice Malta was my humble contribution towards turning a dream to complete St Michael Hospice into reality.

The comfort and dignity that Hospice Malta provides free of charge are truly unparalleled. I am grateful for the opportunity to support this cause and make every step count towards compassion and positive change.”

Michael Degaetano, deeply touched by his personal experience, shared, “My mother Cecilia, a regular Malta half-marathon participant, passed away recently after her fight with cancer. The support we received from Hospice Malta was incredible. Participating in this Walkathon was my way of expressing gratitude and raising funds to support the remarkable work they do.”

George Navarro, inspired by his family’s journey, emphasised the significance of giving back, saying, “Witnessing my father’s selfless commitment to this cause and experiencing the care provided to my uncle has deeply touched my heart. Participating in the LifeStar Malta Marathon was a meaningful way for me to contribute and ensure that Hospice Malta continues its invaluable work.”

Together, these compassionate individuals have collectively raised over €3,200, which will further contribute to sustaining Hospice Malta’s vital services.

Pelin Kaya Murderer Sentenced To 40 Years In Prison

Jeremie Camilleri, a Maltese-French national residing in Lija, has been sentenced to 40 years in prison for the murder of Turkish interior designer Pelin Kaya. Camilleri admitted guilt last month for the fatal incident, which occurred on January 18, 2023. 

He deliberately struck Kaya with his BMW car on Testaferrata Street, Gżira, after she had celebrated her birthday. Witnesses reported that Camilleri emerged from the wreckage and pelted stones at Kaya’s body, subsequently assaulting others in the vicinity and resisting arrest, necessitating the use of a taser.

Madam Justice Consuelo Herrera condemned Camilleri’s violent actions, highlighting his history of offenses and disregard for previous suspended jail terms. She emphasized the severity of his behavior, noting that Kaya was killed while walking on a sidewalk. 

While the judge deemed the circumstances deserving of a harsher penalty, she imposed a 40-year sentence, a €5,000 fine, and €20,000 in court expenses. Additionally, Camilleri’s car was confiscated, and his driver’s license permanently revoked.

During sentencing, Camilleri, dressed in a black suit, remained composed as an English translator relayed the judgment. Kaya’s family and friends attended the hearing. Initially pleading not guilty, Camilleri later changed his plea, citing an agreement reached with all parties, including Kaya’s family. Despite a joint application proposing a lesser sentence, the judge deemed it inadequate, emphasizing Camilleri’s early admission of guilt. 

The court revealed that Camilleri and Kaya had no prior acquaintance, and Camilleri confessed to the police his desire for notoriety, identifying himself as a psychopath. Blood tests confirmed his intoxication at the time, with cocaine found in his vehicle.

The Private Residential Leases Act (PRLA) was introduced back in 2020 with the goal of ensuring, among other elements, that this sector is rendered more secure and transparent. Four years on, this Legal Study delves deep into the compliance aspect of the Private Residential Rental Sector.

This analysis bridges two different aspects – first by examining the enforcement action conducted by the Housing Authority to ascertain compliance with the lessor’s duty to register the agreement, and then by evaluating how lessors and lessees have been fulfilling their duties towards each other, in an exercise that can be considered a continuation of the analysis contained in the Housing Authority’s 2022 Residential Rental Study. 

This also includes the Adjudicating Panel function carried out by the Housing Authority since 2020.

The key highlights of the Legal Study include the following:

  • As of September 2023, there were 886 notifications issued to non-compliant landlords, 78 of which led to a criminal complaint to the Police.
  • There were 22 decisions delivered by the Court of Magistrates (Criminal Judicature), with 3 decisions appealed before the Court of Appeal (Inferior Jurisdiction) over this period.
  • Although the fine established in the Private Residential Leases Act can range from €2,500 to €10,000, in 12 out of the 15 cases in which the accused was found guilty, the Court imposed the minimum fine permissible by law.
  • The analysis of the Adjudicating Panel decisions in 2022 and 2023 highlights the importance of the inventory in attesting to the true state of the property.
  • The decisions by the Adjudicating Panel indicate that claims to damages following the termination of the lease, or overcharging of utilities, need to be backed by adequate proof, consisting not only of photographic evidence but also of documents, such as quotes or invoices, capable of quantifying such damage. The same applies to tenants claiming overcharging of utility bills.
  • In general, the study indicates that there is a strong case for the competence of the Panel to be extended to, at least, cases of rent and utility arrears and expenses related to the common parts.

This legal study was carried out by Dr Kurt Xerri, resident academic within the Department of Civil Law at the Faculty of Laws of the University of Malta; Dr Bryony Balzia Bartolo, manager of the Legal Office of the Housing Authority; and Dr Stefan Cutjar, an associate at Camilleri Preziosi Advocates and former Policy Consultant to the Ministry for Social and Affordable Accommodation.
